Insurance Company Sues Flooring Contractor for $400,000 Over Stain Rag Fire

An insurance company is suing a West Virginia flooring contractor for $400,000, alleging the contractor’s negligent disposal of stain rags caused a fire in the home where he was working, the West Virginia Record reports.

The contractor, Timothy Martin of T&E Flooring, was hired to renovate a room in a Tornado, W.V., home, where the fire broke out due to stain rags the insurance company claims had not been disposed of properly.

The plaintiff, Twin City Fire Insurance Co., says it paid more than $400,000 to the homeowners for the fire damage per the homeowners’ insurance policy. Along with the $400,000, the insurance company is seeking attorney fees and court costs from the flooring contractor.
