WFCA Encourages Flooring Installers to Use COVID-19 Liability Waivers

As more parts of the country ease COVID-19 restrictions, the World Floor Covering Association (WFCA) is recommending flooring installers have clients sign COVID-19 liability waivers before beginning work.

The waivers could potentially limit claims for damages if a client becomes infected by the coronavirus. However, there remains uncertainty regarding the effectiveness of the waivers and whether they would be enforceable. As Law360 notes, there is currently no COVID-19 liability legislation.

“It is possible that COVID-19 waivers in some jurisdictions will be held to be against public policy,” WFCA stated. “Nonetheless, waivers are recommended because they are easy to employ and if drafted properly, may well be enforced and avoid liability.”

WFCA encouraged flooring professionals to consult legal counsel to make sure the waivers comply with state requirements.
