A class-action lawsuit filed in December against Floor & Decor alleges the company sold laminate wood flooring containing hazardous levels of formaldehyde, according to LegalNewsLine.com.
The suit language appears to be similar in nature to the allegations volleyed at Lumber Liquidators last year: It claims the product in question came from China, and that the product contains formaldehyde in excess of the levels allowed under the California Air Resources Board regulations.
While it's the company's policy not to comment on pending litigation, Floor & Decor did provide this statement: "Floor & Decor maintains the highest commitment to offering safe, quality products to customers at everyday low prices. Floor & Decor is equally committed to complying with all applicable laws and regulations."
The list of allegations includes breach of express and implied warranties, fraudulent concealment, negligent misrepresentation, negligence, unjust enrichment, violations of the Magnuson-Moss Warranty Act, and violations of California, Nevada, Georgia, Tennessee and Texas state laws.
The plaintiffs are seeking $5 million.
