Plaintiff William Klaehn, who first filed the complaint in the Southern District of California in August, alleged the flooring is “prone to damage, cracking, warping, and other problems,” despite being advertised as long-lasting, durable and guaranteed to last 50 years, according to the report. Klaehn purchased Cali Bamboo Bordeaux Fossilized Flooring and Pergo Gold underlayment from Lowe’s in April 2018 and began to see cracks and scuffing in December 2018, the report states.
Lowe’s reportedly informed Klaehn that the adhesive used to install the bamboo floor voided the warranty, despite Cali Bamboo recommending the glue. Cali Bamboo offered to provide T-moldings and have an inspection of the flooring and provide a refund if a manufacturing defect was found, but Klaehn chose not to proceed with the inspection, according to the report.
Klaehn argued the product’s defects were widespread and represents a class of consumers who bought Cali Bamboo solid bamboo flooring from Lowe’s since Jan. 1, 2012 or was sold it directly by Cali Bamboo between Jan. 1, 2012–Dec. 31, 2016.
Klaehn filed an amended class action complaint Oct. 16, according to PacerMonitor.
In late September, Lumber Liquidators settled a $30 million class-action lawsuit over alleged defects in its Morning Star Strand Bamboo flooring.
