Wadleigh Tile says it is owed $213,824 for installing wood flooring in 11 condos and hallways throughout seven floors of a former Montgomery Ward department store that were converted into 240 luxury condos. The work began in 2007. Wadleigh Tile filed liens against the project's developer, OMP Development, in September; since then, the building was sold to Wealth Diversified Fund (Dallas), against whom Wadleigh Tile filed suit.
Jeff Leach, the company's attorney, told the Star-Telegram that Wadleigh Tile can reuse or sell the flooring, and that further use by building visitors is decreasing its value. Leach is asking the judge for an injunction that would stop people from walking on the floors until the matter is resolved.
The suit is just one in a string of legal proceedings surrounding the development, ensnaring project financiers, real estate developers, Citibank, a general contractor-who claims it is owed more than $6.6 million-and more than a dozen subcontractors.
