Appeal Denied in Lawsuit Against Lumber Liquidators Invoice Policy

A lawsuit filed against Lumber Liquidators in New Jersey for not including delivery dates on invoices for hardwood flooring was not revived by the New Jersey Appellate Division on Aug. 22, according to Law360.

The plaintiffs argued that hardwood flooring met the state’s regulatory definition for “household furniture,” and the sale of household furniture in New Jersey requires invoices to include a line that promises delivery by a certain date.

The Appellate Division judges agreed with the judge’s decision in the initial court case—hardwood flooring is not household furniture, and the sale of hardwood flooring does not require the seller to promise a delivery date in the invoice.
