OSHA Vaccine Mandate for Large Businesses Is Reinstated By Court

A COVID-19 vaccine mandate for businesses with 100 or more employees has been reinstated after a court lifted a temporary injunction, Reuters reported.

The 6th U.S. Circuit Court of Appeals in Cincinnati lifted the injunction Dec. 17 after blocking the OSHA rule in November for further review.

"It is difficult to imagine what more OSHA could do or rely on to justify its finding that workers face a grave danger in the workplace," according to the court’s opinion on the reinstatement. "It is not appropriate to second-guess that agency determination considering the substantial evidence, including many peer-reviewed scientific studies, on which it relied."

Immediately following the circuit court’s decision, multiple states and organizations filed challenges to the rule, asking the Supreme Court to block the vaccine mandate, according to Reuters.

The OSHA vaccine mandate requires full vaccination status for businesses with 100 or more employees by Jan. 4, after which unvaccinated workers at the businesses would be required to submit negative COVID-19 tests weekly and wear face masks indoors.
