As more and more states start to mandate the PaintCare Architectural Product Stewardship Program, many manufacturers and contractors are confused as to which "architectural coatings" can be assessed a PaintCare Recovery Fee to fund the stewardship program, and recently the rule was clarified that wood floor finishes labeled for professional use are not subject to the fees.
Wood floor sealers and finishes, swimming pool paints and non-asphalt roof coatings that are labeled "for professional use only," "for industrial use only," "not for residential use," or "not intended for residential use" are exempt from the fee.
The purpose of the paint stewardship programs is to collect and recycle unused paint, stains, and coatings that are normally disposed of by government-sponsored household hazardous waste (HHW) programs. Because wood floor sealers and finishes, pool paints and roof coatings labeled for professional use are not known to be a problem at HHW programs, they need not be collected by PaintCare and therefore there is no need to charge a fee to fund the program, according to PaintCare.
