Shaw Industries (Dalton, Ga.) sued Carlisle Wide Plank Floors (Stoddard, N.H.) for trademark infringement and deceptive trade practices. The suit, filed in August in an Atlanta federal court, stems from Carlisle's use of the word "epic" in marketing material.

Carlisle says it is "The Epic Wide Plank Floor Company." But Shaw said it has had exclusive rights to the use of "EPIC" since 2006. Shaw uses the word in reference to its engineered wood flooring.
The company said it told Carlisle to stop using the word in June.
Shaw is seeking unspecific damages and any profits Carlisle made while using "epic" to refer to its products.
