The class action lawsuit filed by plaintiff Dana Gold alleged that the Morning Star brand of bamboo flooring is defective, despite propagating information online and at trade shows that the product is high-quality and defect-free, according to Law360.
Lumber Liquidators did not return a request for comment.
The complaint alleged that homeowners have spent thousand of dollars repairing or replacing the flooring long before the end of its 30-year warranty. Specifically, the suit said:
“The product is a manufactured wood product that is defectively designed, tested, and manufactured, and will warp, buckle, splinter and unreasonably scratch and dent when used in its intended manner. This failure is common in the product, regardless of when, where or how it is installed. Due to the defective nature of the product, it is not sufficiently durable to serve as flooring.”
The complaint also mentioned that Lumber Liquidators commissioned "sham" inspections of customers' homes to "mislead consumers into believing that the defect could be traced to shoddy installation," according to Law360.
