A lawsuit against LL Flooring claims the retailer “breached its duty of care” when an employee driving a hi-lo ran over a customer’s foot, causing him to fall backward, Lawyers Weekly reported.
LL Flooring filed for a summary judgment, which was denied by a district judge in February. The incident occurred Jan. 19, 2021, at LL Flooring’s Redford Township, Mich., location. Using a hi-lo, a type of forklift, the employee at the location drove five boxes of flooring to the customer’s car. At one point, instead of lifting the pallet higher, the hi-lo moved forward, running over the customer’s foot and causing him to fall into his car.
The customer did not immediately seek medical treatment, but went to urgent care later that same day, where X-rays showed his foot was bruised but not broken, according to the report. The customer later underwent two discectomies on his lumbar spine and still suffers from sciatica, injuries he claims resulted from the incident at LL Flooring.
