Opinion to Remand Chinese Plywood Anti-Dumping Decision Now Public

The judge’s opinion on the decision to remand the International Trade Commission’s conclusion not to impose anti-dumping and countervailing duties on hardwood plywood from China has been released to the public.

The 83-page decision outlines U.S. Court of International Trade Judge Richard Eaton’s explanation for remanding the ITC’s decision, made in November 2013.

Eaton said, “[B]ecause the Commission failed to consider properly the magnitude of the dumping margins, its analysis of the statutory factors leading to its negative injury determination, is unsupported by substantial evidence and is not in accordance with law.”

The case now goes back to the ITC to reconsider the impact of dumping margins on the domestic hardwood plywood industry.
