The 83-page decision outlines U.S. Court of International Trade Judge Richard Eaton’s explanation for remanding the ITC’s decision, made in November 2013.
Eaton said, “[B]ecause the Commission failed to consider properly the magnitude of the dumping margins, its analysis of the statutory factors leading to its negative injury determination, is unsupported by substantial evidence and is not in accordance with law.”
