Lawsuit: Wood Flooring Company Wouldn’t Pay All Overtime Hours

A former employee at a wood flooring company in in Houston filed a lawsuit against the company July 8 that alleged he was not paid overtime, according to the complaint filed in the Southern District of Texas court in Houston.

Olvin Gamez worked for Frias Hardwood Floors between 50–60 hours each week, but did not receive time and a half for the extra hours he worked, according to the filing. The complaint claims the company told Gamez he was only entitled to be paid for eight hours of overtime per week, no matter how many hours of overtime he worked.

The complaint describes the company’s action as a “clear violation of the Federal Labor Standards Act.”

When Hardwood Floors contacted the company owner, Julio Frias, on July 19, he said he had not heard about the lawsuit and would have to do more research before commenting.

Gamez is seeking compensation for the amount of overtime worked, an equal amount of liquidated damages, attorney fees and legal costs.
