Dismukes, a Republican who served in the Alabama House of Representatives from 2018 to 2022, was arrested in 2020 and indicted June 2021 on charges of stealing more than $2,500 in materials from Weiss Commercial Flooring between 2016 and 2018. Charges were filed after his former employer approached the district attorney, according to WVTM 13.
During the trial, the state illustrated that Dismukes “significantly overcharged” Weiss Commercial Flooring when filling out pay applications for his father, a subcontractor, before cashing checks through his own bank account, according to the Alabama Political Reporter.
Dismukes maintained his innocence during testimony Thursday, stating he’d signed a $32,000 repayment plan with Weiss Commercial Flooring to pay back money he believed he’d rightfully earned by “double dipping,” Alabama Political Reporter reported. Dismukes said he’d never stolen from the company but admitted to breaking company policy by helping his father install flooring while acting as project manager.
Dismukes was found guilty of two “aggravating factors” in the case, having had both a fiduciary duty with the company and “an elaborate scheme that took place over a period of time involving a victim victimized more than once,” according to the Montgomery County District Attorney’s Office. Dismukes faces two to 20 years in prison and will be sentenced May 4.
“I am very pleased with the jury’s conviction in this case,” District Attorney Daryl Bailey said in a statement. “Dismukes' thievery cost a local business thousands of dollars in stolen revenue. This is the first time in history that a Montgomery jury has found an aggravator in a theft case. Because of this my office will be seeking significant prison time for Mr. Dismukes."
